TITLE D—INCHOATE CRIMES
ARTICLE 35. CRIMINAL SOLICITATION
§ 35.00 Criminal solicitation in the second degree.
- A person is guilty of criminal solicitation in the second degree when he intentionally
solicits, requests, commands, or otherwise attempts to cause such another person to engage in a conduct constituting a crime.
- Criminal solicitation in the second degree is a violation.
§ 35.05 Criminal solicitation in the first degree.
- A person is guilty of criminal solicitation in the first degree when he intentionally
solicits, requests, commands, or otherwise attempts to cause such another person to engage in a conduct constituting a felony.
- Criminal solicitation in the first degree is a class A felony.
§ 35.10 Criminal solicitation; no defense
It is no defense to a prosecution for criminal solicitation that the person solicited could not be guilty of the crime solicited.
ARTICLE 40. CONSPIRACY
§ 40.00 Conspiracy in the fourth degree
- A person is guilty of conspiracy in the fourth degree when, with intent that the
conduct performed constitutes a crime, he agrees with one or more persons to engage in or cause the performance of such conduct.
- Conspiracy in the fourth degree is a class A misdemeanor.
§ 40.05 Conspiracy in the third degree
- A person is guilty of conspiracy in the third degree when, with intent that the
conduct performed constitutes a class C felony, he agrees with one or more persons to engage in or cause the performance of such conduct.
