IN FAVOR OF THE DEFENSE;
The command used in the evidence presented was a command for a bot named “Duck Hunt” which is a well known arcade game in the 80s and 90s on discord and the website for said bot says it is a game just like its physical counterpart.
The defendant has been known to joke about such things multiple times and has shown this time to be no different, even when addressing someone else no reasonable mind would assume such a statement to be true
The pretense of a Terms of Service violation is up to server staff and Discord themselves to enforce, granted Discord is well known to be inefficient at actively pursuing Terms of Service violations it is not up to the Justice Department to decide whether someone is guilty of a Terms of Service violation
The charge the prosecution wanted to add of resisting arrest was not because of the defendant but because of the prosecutor's inability to properly attain permissions to imprison someone, this is most likely because the prosecutor was not an officer of the law at the time of arrest.
The evidence shown of the defendant wanting Desmond to “silence” someone was in regards to a joke about how the United States uses the Immigration and Customs Enforcement (ICE) to arrest and kill innocent civilians during protests.
The evidence shown of Mr. Desmond Von Klue using a command for a robot is voided in this case as it was not done by the defendant and was done on his own will which was non-coercive.
The defense further adds that the pretext of “His bounty is $12” being used as anything more than a joke is absurd as it is such a low amount and in a foreign currency, anyone with a reasonable mind would rightly take such a statement as a joke and nothing more.
THEREFORE, the defense respectfully requests that the instant motion be GRANTED and that this action be DISMISSED.
