MOTION FOR TEMPORARY RESTRAINING ORDER

NOW COMES, Complainant respectfully moves this Honorable Court for the issuance of a Temporary Restraining Order (“TRO”) enjoining enforcement of the “National Firearm Control and Public Safety Act” pending full judicial review.:


I. Likelihood of Success on the Merits

The complainant is likely to succeed on the merits because the Act is in violation of Article 27 of the Constitution of the Republic of Krameria, which does not grant Congress authority to the National Congress to regulate military arms, but not civilian.

II. Irreparable Harm

Absent immediate relief, the Complainant and similarly situated citizens will suffer irreparable harm through the ongoing deprivation of constitutional rights protected under the constitution. The requirement to obtain government permission to exercise a protected right, combined with the threat of criminal penalties for noncompliance, constitutes a direct and continuing injury that cannot be remedied after the fact.

III. Public Interest

The public interest is best served by upholding the Constitution and preventing enforcement of laws enacted beyond the scope of governmental authority. Protecting fundamental rights and maintaining constitutional order outweighs any asserted regulatory interest.
