Republic of Krameria Defendant.
This Court has jurisdiction pursuant to Article 37 of the Constitution of the Republic of Krameria, which grants the Supreme Court authority over controversies involving the Republic and matters arising under the Constitution.
On or about March 30, 2026, the Defendant, acting through the President, issued Executive Order #1430 – Restoration of the Romarian Presidency.
This Order abolished the office of “Governor of Romaria” and replaced it with the office of “President of Romaria,” thereby restructuring the governance of the territory of Romaria.
The Order was issued unilaterally by the executive without the passage of an organic act of Congress.
As a result of these actions, the Complainant has suffered injury in that the constitutional order governing territorial administration has been violated, undermining the rule of law and the proper separation of powers guaranteed by the Constitution.
Count I — Violation of Article 9 (Territorial Governance Clause) The Defendant’s conduct violated Article 9, which provides that governance of territories shall be conducted through organic acts of Congress. The unilateral executive restructuring of Romaria constitutes an unlawful exercise of power reserved exclusively to Congress.
Count II — Violation of Separation of Powers (Articles 18 and 27) The Defendant, through executive action, exercised legislative authority reserved to Congress under Article 27, exceeding the executive powers defined in Article 18. Such conduct represents an unconstitutional usurpation of legislative authority.
Count III — Supremacy of the Constitution (Article 5) By issuing an order inconsistent with the Constitution, the Defendant violated Article 5, which establishes the supremacy of the Constitution over all other laws and executive actions.
Such actions are unlawful and give rise to this complaint.
Complainant respectfully requests that this Court grant the following relief:
A declaration that Executive Order #1430 is unconstitutional and void ab initio; An injunction prohibiting the enforcement or implementation of said Executive Order; An order restoring the lawful governance structure of the territory of Romaria as it existed prior to the issuance of the Order; Such other and further relief as this Court deems just and proper.
