BILL OF COMPLAINT

Jurisdiction

This Court has jurisdiction pursuant to Article 37 of the Constitution of the Republic of Krameria, as this case arises under the Constitution and concerns the administration and legality of a federal election.

Statement of Facts

On or about the date of the Speakership election, a vote was conducted within the House of Representatives to determine the Speaker. The Defendant, Sophea Fitzgerald House, presided over the election while also being a candidate.

During the voting process, Members cast votes in favor of Phillip Von Klue using variant spellings, including but not limited to “Philip,” “Phillip,” and “Philipe Von Klue.” These votes clearly indicated intent to vote for the same candidate.

Upon tabulation, the Defendant counted these votes as separate and distinct entries rather than consolidating them as votes for Phillip Von Klue. Meanwhile, votes cast for the Defendant were consistently counted as a single unified total.

As a result, the Defendant declared herself reelected as Speaker despite the fact that a proper and reasonable tabulation of votes would have resulted in Phillip Von Klue receiving a majority.

The Complainant, as a citizen of Krameria, brings this action to preserve the integrity of democratic processes and ensure compliance with the Constitution. Cause(s) of Action

Count I – Violation of Equal Protection (Article 52) The Defendant applied inconsistent standards in the counting of votes, thereby granting unequal treatment to similarly situated voters. Votes clearly intended for Phillip Von Klue were fragmented and diluted, while votes for the Defendant were not, violating the constitutional guarantee of equal protection.

Count II – Violation of Due Process (Article 50) The inconsistent and unreasonable tabulation of votes deprived participants in the election of a fair and impartial process, undermining the legitimacy of the outcome and violating due process protections.

Count III – Failure to Ensure Electoral Integrity (Article 27) The administration of the election failed to ensure accurate and reliable vote counting, contrary to the constitutional responsibility to regulate elections and prevent irregularities.

Count IV – Procedural Impropriety and Conflict of Interest The Defendant presided over an election in which she was a candidate and exercised discretionary authority over vote tabulation. This created a conflict of interest and compromised the impartial administration of the election.

Prayer for Relief

Complainant respectfully requests that this Court grant the following relief:

A declaration that the results of the Speakership election are unconstitutional and invalid; An order requiring the correction and proper tabulation of the votes cast, consolidating all votes reasonably intended for each candidate; In the alternative, an order requiring a new election for Speaker conducted under impartial supervision; Any further relief the Court deems just and proper to preserve democratic integrity within the Republic of Krameria.
