Jurisdiction is invoked based on the Inherent Authority of the Supreme Court to resolve disputes between sovereign entities and private citizens where no other forum for ultimate truth exists. This action involves a multi-jurisdictional commercial dispute, the protection of proprietary "Genius" Intellectual Property, and a claim against a high-ranking state official for actions taken under the colour of law.
The Plaintiff, observing the "Apparent Authority" of the Governor, invested $operational capital and thousands of man-hours of "Genius" labor to produce the Scholaris Unified Environment.
The Plaintiff delivered the intellectual property. The Defendants accepted the delivery.
The State now attempts to "void" the reality of this transaction. They claim the Governor lacked the "authority" to sign, yet they remain in possession of the intellectual assets delivered, which cannot reasonably be removed from their minds.
A State cannot benefit from the actions of its leader and then disclaim his authority when the bill arrives. If the Governor’s signature is "void" for the payment, it must be "void" for the delivery. The State cannot keep the tech if they refuse the debt.
If the Governor acted outside the law, he committed Private Fraud. If the State is not liable, Fawn is liable personally for the K 60,000.00.
Logic dictates that no party may be enriched at the expense of another through a "legal technicality." To retain the Scholaris Specs without payment is a theft of the mind.
A. COMPENSATORY DAMAGES: An immediate award of K 60,000.00 representing the unpaid Design Fee for the Scholaris Unified Environment, as executed in the signed Agreement.
B. PUNITIVE & EXEMPLARY DAMAGES: An award of K 120,000.00 (Double Damages) to punish the Defendants for their bad-faith attempts to "void" a valid contract and their reckless disregard for the Complainant’s proprietary intellectual labor.
