§38.1 Where an appeal is heard within the Circuit Court, it shall be assigned to a Judge who did not preside over the original proceedings.

§38.2 The appellate Judge shall determine the appeal based on:

• (a) the full trial record;
• (b) all evidence admitted at trial;
• (c) written submissions of the parties;
• (d) any relevant procedural rulings.

§38.3 The appellate Judge may:

• (a) affirm the original decision;
• (b) vary the original decision;
• (c) reverse the original decision;
• (d) order a new trial before a different Judge.

§38.4 The appellate Judge shall not be required to conduct a full rehearing unless the interests of justice so require.
