§30.1 Where a party fails to comply with a Court order, the Court may impose sanctions proportionate to the nature and severity of the non-compliance.
§30.2 Sanctions may include:
- (a) limitation of participation in proceedings;
- (b) exclusion of evidence;
- (c) adverse findings or inferences;
- (d) financial or procedural penalties;
- (e) any other measure necessary to uphold the authority of the Court.
§30.3 In determining appropriate sanctions, the Court shall consider:
- (a) whether the non-compliance was intentional;
- (b) the impact on proceedings;
- (c) the need to deter similar conduct.
