§28.1 The Court may dismiss a proceeding where there has been prolonged or unjustified inactivity.
§28.2 In determining whether to dismiss, the Court shall consider:
- (a) the length of delay;
- (b) the reasons for delay;
- (c) any prejudice caused to the opposing party;
- (d) the overall interests of justice.
§28.3 Dismissal under this Article may be:
- (a) with prejudice, preventing refiling; or
- (b) without prejudice, allowing the matter to be brought again.
