§25.1 Where a party fails to appear, respond, or otherwise participate in proceedings without reasonable justification, the Court may proceed in their absence.

§25.2 Prior to proceeding in the absence of a party, the Court shall be satisfied that:

• (a) adequate notice of proceedings was provided;
• (b) a reasonable opportunity to respond or appear was given;
• (c) the failure to participate is not due to circumstances beyond the party’s control.

§25.3 The Court may issue directions or orders designed to encourage participation before proceeding in absence, including warnings or final notices.
