Upon a summons being issued pursuant to section 233.805 of this title, a hearing shall be held with a Prosecutor, the offender, and their counsel, and the presiding judge shall—

(1) allow the offender to remain on probation, with or without extending the term of probation, if less than the maximum authorized term was previously imposed; or

(2) revoke the offender’s probation and sentence, and resentence them.
