Any criminal forfeiture must be requested by the Prosecution prior to or during sentencing proceedings. The Prosecution must prove, by a preponderance of the evidence, that the property to be forfeited was related to the commission of the offenses for which the offender was convicted, or that the property was gained as a direct result of the criminal activity.
