Writs of Procedendo shall be established as an extraordinary form of relief, and shall be used to order inferior courts to continue proceedings and issue a final ruling in the matter in accordance with the law.
(1) Any Petitioner seeking a Writ of Procedendo shall be required to show that they have a legal right to the relief sought, that the Respondent has a legal duty to perform the requested act, and they have no other adequate recourse in the ordinary course of law.
(2) Writs of Procedendo shall only be utilized if a Court is unduly delaying a determination, or has failed to release a decision, verdict, judgment, or final order in a timely manner, in accordance with the law. If a determination is made that a decision is to be reversed or vacated, and the case is to be reheard, the matter shall instead be remanded.
