The Supreme Court, when having reheard a case en banc, may—

(1) affirm, modify, vacate, set aside or reverse any judgment or order before it on review; and

(2) remand the case and direct the entry of any appropriate judgment or order, or require such further proceedings to be had as may be just under the circumstances.
