(a) A person is guilty of the offense of Commercial Bribery when they corruptly,—
(1) give, offer to give, or promise any money, job, position, benefit, or other thing or item of actual or perceived value to a person of trust in an organization, corporation, or business with the understanding that said money, benefit, or other thing will influence their conduct in their professional capacity as a person of trust, or the conduct of the organization, corporation, or business which they own, or which employs or contracts with them; or
(2) as a person of trust in an organization, corporation, or business, solicit, accept, agree to accept, or promise to accept any money, job, position, benefit, or thing or item of actual or perceived value with the understanding that said money, benefit, or other thing will influence their conduct in their professional capacity as a person of trust, or the conduct of the organization, corporation, or business which they own, or which employs or contracts with them.
(b) Commercial Bribery is a Third-Degree Felony.
