(a) A person is guilty of the offense of Operating an Illegal Gambling Enterprise when, while a means of registering a gambling enterprise is publicly available or while there are publicly accessible regulations or restrictions on the registration, foundation, or operation of any such enterprises, they—

(1) advertise or represent an organization, business, channel, or corporation as being a gambling enterprise, when it is not authorized by law to act as such; or

(2) facilitate unlawful gambling on behalf of another, or on behalf of an organization, business or corporation.

(b) Operating an Illegal Gambling Enterprise is a Third-Degree Felony.
