(a) A person is guilty of the offense of Violation of Terms of Service when they violate the Discord Community Guidelines or Terms of Service.

(b) Except as otherwise described in this section, Violation of Terms of Service is a Third-Degree Felony.

(c) If the Violation of Terms of Service involved—

(1) threats of violence or harm to another;

(2) uses Discord to spam, manipulate engagement, or disrupt other people’s experience;

(3) abuses Discord products in any way; or,

(4) uses self-bots or user-bots,

the offense shall be enhanced, and it is a Second-Degree Felony.

(d) If the Violation of Terms of Service involved—

(1) the sexualization of children in any way;

(2) the sharing of sexually explicit content of another person without their consent;

(3) activities intended to cause damage or gain unauthorized access to another user's account, network, or system;

(4) the sharing of content that glorifies or promotes suicide or self-harm;

(5) the sharing of real media depicting gore, excessive violence, or animal harm, especially with the intention to harass or shock others;

(6) the sharing of content that violates anyone's intellectual property or other rights;

(7) the sharing of false or misleading information (otherwise known as misinformation);

(8) the organization or promotion of, or engagement in, any illegal, hazardous, or dangerous behavior;

(9) the coordination of, or participation in, the malicious impersonation of an individual or an organization; or,

(10) the distribution of, or provision of access to, content involving the hacking, cracking, or distribution of stolen goods, pirated content, or accounts,

the offense shall be enhanced, and it is a First-Degree Felony.
