(a) A person is guilty of the offense of Obscenity when they post material, or a link to such material, which depicts sexual conduct, violence, or which otherwise contains obscene content outside of any designated ‘not safe for work’ channels.

(b) Except as otherwise described in this section, Obscenity is a Second-Degree Felony.

(c) If the Obscenity involved extreme gore or violence, mutilation, or any other inordinately obscene, frightening, or offensive content, or a link to any such content, the offense shall be enhanced, and it is a First-Degree Felony.
