(a) A person is guilty of the offense of Improper Release of Confidential Materials when they, knowingly and without lawful authority, disclose to any unauthorized person, or release publicly, any material or information deemed confidential or protected by executive order or the law.

(b) Except as otherwise provided in this section, Improper Release of Confidential Materials is a Third-Degree Felony.

(c) If the Improper Release of Confidential Materials is found to involve materials protected for the sake of national security or individual privacy, the offense shall be enhanced, and it is a First-Degree Felony.
