(a) A person is guilty of the offense of Dereliction of Duty when they, as a government official or member of staff, negligently or recklessly—
(1) fail to serve or enforce a lawful warrant;
(2) fail to prevent or halt the commission of a criminal offense of which they are or should be aware;
(3) fail to report the commission of a criminal offense of which they are or should be aware;
(4) fail to prevent or halt the escape of any person held in custody;
(5) fail to prevent or halt the evasion of any judgment by a court;
(6) fail to perform a duty expressly required of them by the law or Constitution; or,
(7) carry out, or attempt to carry out, any official act expressly forbidden by law or the Constitution.
(b) Dereliction of Duty is a Second-Degree Misdemeanor.
