(a) A person is guilty of the offense of Abuse of Staff Powers when they, as a member of staff, abuse their permissions or privileges in a manner not permitted by law, server rules, or staff rules, in order to—

(1) unban a person lawfully sentenced to death;

(2) free a person from jail who was lawfully sentenced to a term of imprisonment;

(3) ban, kick, or mute a person for the purposes of infringing on their rights under the Constitution; or,

(4) imprison any person who has not been arrested or lawfully sentenced to a term of imprisonment.

(b) Misuse of Staff Powers is a Third-Degree Felony.

(c) Nothing in this Section shall be construed as restricting legitimate moderation and server administration.
