(a) A person is guilty of the offense of Unauthorized Practice of Law when they, while not accredited to practice law, while a process for obtaining such a license or accreditation is publicly available—

(1) advertise themself as licensed, accredited, or otherwise entitled to practice law;

(2) pretend to be licensed, accredited, or otherwise entitled to practice law; or,

(3) practice law to advocate for or defend another person, unless as authorized by law.

(b) Except as otherwise provided in this section, Unauthorized Practice of Law is a First-Degree Misdemeanor.

(c) If the Unauthorized Practice of Law involved the transfer of funds, or any other thing or item of actual or perceived value from a legal client to the offender, the offense shall be enhanced, and it is a Third-Degree Felony.
