(a) A person is guilty of the offense of Making False Statements when they knowingly, and with the intent to mislead or misinform investigators—
(1) falsify, conceal, or cover up by any trick, scheme, deception, or fraud any material fact;
(2) make any materially false, fictitious, or fraudulent statement or representation while being questioned by or in the custody of any law enforcement agency or any representatives of the Department of Justice;
(3) use or present any false writing or document knowing it to contain any materially false, fictitious, or fraudulent statement or entry; or,
(4) submit any false reports or evidence of criminal activity to law enforcement agencies or other government bodies.
(b) Except as otherwise provided in this section, Making False Statements is a Third-Degree Felony.
(c) If the offense of Making False Statements was committed in the manner described in subsection (a)(4), and a person was detained, arrested, or criminally charged as the result of false reports being submitted to the government, the offense shall be enhanced, and it is a Second-Degree Felony.
