(a) A person is guilty of the offense of Perjury when they intentionally make a false statement which they do not believe to be true while giving testimony to any court, body, agency, or public servant legally permitted to conduct the proceedings, while under oath, or while under oath in a lawful written instrument.
(b) Perjury is a Third-Degree Felony.
(c) In any prosecution for Perjury, it is an affirmative defense that the Defendant retracted their false statement in the course of the proceeding in which it was made before such false statement substantially affected the proceeding and before it became manifest that the falsity was or would be exposed.
(d) It is no defense to a prosecution for Perjury that the Defendant believed the false statement was immaterial, or that the oath was administered or taken in an irregular manner.
