(a) A person is guilty of the offense of Participating in a Criminal Enterprise when they commit or conspire to commit, as part of a conspiracy, five or more Felony or Capital offenses, or any combination of such offenses.

(b) Participating in a Criminal Enterprise is a First-Degree Felony.
