As used in this chapter:

(1) “Offense” means conduct for which a sentence to a term of imprisonment, or to a fine, or both, is provided by any law of the Republic of Krameria.

(2) “Misdemeanor” means an offense for which a sentence to a term of imprisonment in excess of seven days cannot be imposed.

(3) “Felony” means an offense for which a sentence to a term of imprisonment in excess of seven days may be imposed.

(4) “Capital Offense” means an offense for which a sentence of death may be imposed.

(5) “Crime” means a misdemeanor, felony, or capital offense.

(6) “Person” means an individual, and where appropriate, a corporate, company, association, organization, or agency.

(7) “Government official” means any public officer or employee of the government, or any person exercising the powers or authority of any such public officer or employee.

(8) “Member of staff” means any member of the server’s ownership or staff, or any person exercising the powers or authority of any such member of staff.

(9) “Law enforcement” means any agency, officer, or organization which has been granted authorization under the law or Constitution to investigate offenses and arrest or detain individuals.

(10) “Investigator” means any person who, while serving in a law enforcement capacity, is investigating an alleged crime or offense.

(11) “Proceeding” means any court hearing, trial, staff hearing, investigative hearing, or any other matter authorized by law which involves the investigation or determination of legality of any alleged offense.

(12) “Officer of the Court’ means any lawyer, prosecuting attorney, judge, or Justice, involved in the argumentation, adjudication, or disposition of an arraignment, hearing, or trial.

(13) “Oath” includes an affirmation and every mode authorized by law of attesting to the truth of what is being stated.

(14) “Testimony” means any statement made under oath during a lawful proceeding.

(15) “Defraud” means to willfully or recklessly deceive, mislead, or trick another for the sake of personal gain, or gain for a third party, through the use of misrepresentation or lies, or through the exclusion of material information.

(16) “Canvassing” means soliciting any person to vote in an election or binding referendum through the use of direct messages, or through messaging them in foreign servers, excluding any servers affiliated with the Republic, including the servers of any states and political parties.

(17) “Obscene” means anything that a reasonable person, applying contemporary community standards would find to appeal to the prurient interest, or which depicts or describes in an offensive or violent manner any sexual conduct, acts of cruelty, or acts of violence, and which lacks serious literary, artistic, political, or scientific value.

(18) “Discord Community Guidelines” means the community guidelines and rules prescribed by Discord Inc., and that are found at https://discord.com/guidelines.

(19) “Terms of Service” means the terms of service for Discord, prescribed by Discord Inc., and that are found at https://discord.com/terms.

(20) “Banking and financial services” means any services involving the taking or acceptance of monetary deposits, or the deposits of any other thing of value, in a designated account or for safekeeping generally, providing interest payments for any such deposits, or involving the lending of money.

(21) “Securities exchange” means any place, business, corporation, or exchange wherein persons can purchase, sell, or trade securities, including currencies, stocks, bonds, derivatives, and any other financial instruments.

(22) “Securities” means any currencies, stocks, bonds, derivatives, or other financial instruments.

(23) “Person of trust” means any attorney, accountant, agent, employee, manager, director, advisor, administrator, or any other participant in the direction of the affairs of an organization, corporation, or business.

(24) “Gambling” means engaging in any game of chance, including blackjack or roulette, where a player provides any thing of value in hopes of making a gain.

(25) “Gambling enterprise” means any business, corporation, channel, or entity which facilitates gambling or wagers.

(26) “Personal information” means any identifiable sensitive information about a person, including but not limited to their legal name, address or location, place of work, or banking information.
